Utah’s Multiple DUI Law

In Utah, a person can be charged with a first-offense DUI if they are driving or in actual physical control of a vehicle and have a blood or breath alcohol concentration (BAC) of .08% or higher. A first-offense DUI is a class B misdemeanor and carries a minimum sentence of 48 hours in jail, a fine of at least $700, and a 120-day license suspension.

If a person is charged with a DUI within 10 years of their previous DUI conviction, it will be considered a multiple DUI. The penalties for a multiple DUI are much harsher than those for a first-offense DUI.

The penalties for a second, third, and subsequent DUI in Utah are as follows:

  • Second DUI – A second DUI is also a class B misdemeanor. If convicted, you will face a mandatory minimum sentence of 10 days in jail. The maximum sentence is 180 days in jail. You will also be required to pay a fine of at least $800 and have your license suspended for 2 years.
  • Third DUI – A third DUI is a third-degree felony. If convicted, you will face a mandatory minimum sentence of 62 days in jail. The maximum sentence is 5 years in prison. You will also be required to pay a fine of at least $1,500 and have your license suspended for 2 years.
  • Fourth or subsequent DUI – A fourth or subsequent DUI is a third-degree felony. If convicted, you will face a mandatory minimum sentence of 150 days in jail. The maximum sentence is 5 years in prison. You will also be required to pay a fine of at least $2,500 and have your license suspended for 2 years.
